Service: PlotSmarter web app and related services (the "Service")
1) Acceptance
By accessing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2) Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent you have permission from a parent or guardian.
3) Accounts and Authentication (Google/Firebase)
PlotSmarter uses Google Sign-In and Firebase Authentication for account access. You agree that:
- You are responsible for maintaining access to your Google account and any authentication methods you enable.
- You are responsible for all activity that occurs under your account.
- We may require re-authentication for sensitive actions.
- We may suspend or terminate accounts for fraud, abuse, or violations of these Terms.
4) Subscriptions, Billing, and Payments (Stripe)
PlotSmarter may offer paid features ("Pro") via subscription.
- Payment processor: Payments are processed by Stripe. By purchasing, you authorize PlotSmarter to charge your payment method through Stripe in accordance with these Terms. Stripe may store and process your payment information. PlotSmarter does not store full card numbers.
- Billing cadence: Subscriptions are billed in advance on a recurring basis (monthly or annual, as selected at checkout) until canceled.
- Taxes: Prices may exclude taxes unless stated. You are responsible for applicable taxes, and we may collect taxes where required by law.
- Access tied to payment status: Pro access may be enabled or disabled based on Stripe subscription status (for example, active, past_due, canceled, or unpaid). If payment fails or a subscription becomes past due, Pro features may be restricted until payment is successfully processed.
5) Trials and Promotions (if offered)
If we offer a free trial or promotion, additional terms may apply and will be shown at signup or checkout.
- Trials: When a free trial ends, you are not automatically billed. You will simply lose access to Pro features until you choose to subscribe. Your garden data is preserved.
6) Cancellation and No Refunds
- Cancel anytime: You may cancel your subscription at any time from within your PlotSmarter account settings. Cancellation disables automatic renewal for the next billing cycle.
- Access through billing period: Unless required by law, you will retain access to paid features until the end of your current paid billing period.
- No refunds: All fees are non-refundable. We do not provide refunds or credits for partial subscription periods, unused time, downgrades, or unused features, except where required by law.
- Billing errors: If you believe you were billed in error, contact us at support@plotsmarter.com.
- Chargebacks: If you file a chargeback without first contacting support, we may suspend your account while we investigate.
7) The Service and Disclaimers (Gardening Reality Check)
PlotSmarter provides planning tools, reminders, and recommendations. Gardening outcomes depend on many factors (soil, weather, pests, watering, microclimates, timing, and local conditions). You are responsible for decisions you make using the Service. The Service is informational and is not professional horticultural, agricultural, medical, safety, or legal advice.
8) Acceptable Use
You agree not to:
- Break laws or violate others' rights
- Attempt to hack, scrape, reverse engineer, or disrupt the Service
- Upload malware or attempt unauthorized access
- Abuse trials, promotions, or payment systems
- Use the Service to harass, defraud, or impersonate others
9) Your Content and License
You may submit content like garden layouts, notes, task lists, inventory entries, photos, and other inputs ("User Content"). You keep ownership of your User Content. You grant PlotSmarter a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting/processing), and display your User Content only as necessary to operate, maintain, and improve the Service.
10) Data Processing and Third Parties
PlotSmarter relies on third-party services to operate, including:
- Google/Firebase (authentication, database, hosting, and related infrastructure)
- Stripe (payments and subscriptions)
Your use of the Service may involve these providers processing data necessary to deliver features. Details are described in our Privacy Policy, which is incorporated by reference.
11) Intellectual Property
PlotSmarter's software, branding, and content are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
12) Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk for PlotSmarter or others, or if required by law. We may also restrict access to paid features if your subscription is not active.
13) Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.
14) Limitation of Liability
To the maximum extent permitted by law:
- PlotSmarter is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data.
- PlotSmarter's total liability for any claim related to the Service will not exceed the amount you paid in the 12 months before the event giving rise to the claim (or $100 if you never paid). Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
15) Indemnification
You agree to indemnify and hold harmless PlotSmarter from claims arising out of your use of the Service, your User Content, or your violation of these Terms.
16) Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, United States, excluding conflict of laws rules. Disputes will be resolved in the appropriate local courts of Colorado, and you consent to jurisdiction and venue there.
17) Changes
We may update the Service and these Terms. If changes are material, we'll provide reasonable notice (for example, in-app notice or email). Continued use means acceptance of the updated Terms.
18) Privacy Policy
Your use of the Service is also governed by our Privacy Policy.
